Hit with a Visa Refusal? Beware of the Section 48 Barrier.

If your visa was refused or cancelled while you were in Australia, Section 48 of the Migration Act could block you from applying for most new visas onshore.

But it’s not the end of the road:

  • You might still be eligible for certain exempt visas, like partner, protection, or some skilled visas.
  • You can choose to appeal, leave Australia and apply offshore, or even pursue ministerial intervention, depending on your situation.
  • Timing matters: there’s a checklist & timeline to help you protect work rights and lawful status.  

Section 48 is a major hurdle, but with the right strategy, it’s not insurmountable.
