Family Violence and Australian Visas | Know Your Rights to Stay Safely

If you’re experiencing domestic or family violence, please know — you don’t need to stay in a relationship that puts you at risk. Australia's migration law includes special family violence provisions that allow victims of abuse to remain in the country, even if their relationship has ended.

These laws recognise that your safety and wellbeing come first, not your relationship status.

💚 Who Can Apply Under the Family Violence Provisions

You may be eligible to apply if:

  • You hold, or have applied for, a Partner visa (subclass 820, 309, or 300) or a Dependent Child visa.
  • You experienced domestic or family violence during your relationship.
  • The violence was committed by your partner or spouse while you were together.
  • You are no longer in that relationship because of the violence.

⚖️ Visa Types That May Qualify

Eligibility depends on your visa category:

  • Partner visa holders or applicants (subclass 820, 309, or 300) may qualify if the sponsor was the perpetrator.
  • Dependent children can be included if their parent applies under the same provisions.
  • Secondary visa holders on other visas may qualify if the primary applicant was responsible for the violence.

Each case is assessed carefully by the Department of Home Affairs to ensure genuine claims receive protection.

🕊️ You Have the Right to Safety

You have the right to live safely in Australia, regardless of your visa status. If your relationship ends because of violence, you do not lose your visa pathway automatically — help is available.
